Judges must be protected, Rehnquist says
This piece by him appeared in The Houston Chronicle. Rehnquist is once again putting the interests of the courts as an institution ahead of the interests of the larger country. What he fails to recognize is that the courts have run away with the Constitution, to the point where the Constitution means whatever the Supreme Court says it means, any time it says it. No wonder Patrick Henry "smelt a rat" and didn't attend the Constitutional Convention.
At issue is Tom DeLay's threat to bring Articles of Impeachment against sitting judges who, in his view, wrongfully add to the Constitution. Contempt for the Constitution, in my view, is ample grounds for impeachment. Besides, Rehnquist should take heart in this salient fact: the Senate cannot convict anyone in an impeachment case without the concurrence of two-thirds of the members present.
Will a showdown come between Congress and the courts concerning the meaning of the Constitution? Stay tuned.
